Terms of Service

1. Acceptance of Terms

By accessing or using Kushii ("the platform") at kushii.io, you agree to be bound by these Terms of Service. If you do not agree, do not use the platform.

2. Who Can Use Kushii

You must be at least 13 years old to use Kushii. By creating an account, you confirm that the information you provide is accurate and that you have the authority to agree to these terms.

3. Your Account

You are responsible for maintaining the security of your account and all activity that occurs under it. Notify us immediately at steven@kushii.io if you suspect unauthorized access.

4. Your Content

You retain ownership of all recipes, photos, and content you upload to Kushii. By uploading content, you grant Kushii a non-exclusive, royalty-free license to display and distribute your content within the platform.

You are solely responsible for the content you post. You must not upload content that:

• Infringes on any third-party intellectual property rights
• Is unlawful, harmful, or deceptive
• Violates any applicable laws or regulations

5. Social Platform Integrations

When you connect third-party accounts (such as TikTok) to Kushii, you authorize us to interact with those platforms on your behalf according to the permissions you grant. You remain responsible for ensuring your use of those integrations complies with the respective platform's terms of service.

6. Prohibited Use

You agree not to:

• Use the platform to spam, harass, or harm other users
• Attempt to gain unauthorized access to any part of the platform
• Use automated tools to scrape or extract data without permission
• Impersonate any person or entity
• Upload malicious code or interfere with platform operations

7. Subscription and Billing

Kushii offers free and paid (Pro) tiers. Paid subscriptions are billed through Stripe. You may cancel at any time. Refunds are handled on a case-by-case basis — contact steven@kushii.io.

8. Creator Referral Commission & Launch Promo

Approved creators earn referral commission on subscribers they refer: 10% of recurring payments for free-tier creators, 20% for Pro creators. During the Kushii Launch Promo window, approved creators earn a doubled 40% rate on new referrals. Once earned, that 40% rate remains in effect for that specific referral even after the Launch Promo closes to new signups — but only for as long as the referring creator remains an active, paying Pro subscriber in good standing in the Launch Promo. If a creator downgrades from Pro, cancels their subscription, or is removed from the Launch Promo, their commission on all referrals reverts to the standard rate for their current tier. Commission is paid only on real, completed subscriber payments and is never owed in advance or guaranteed.

9. Intellectual Property

All platform code, design, branding, and non-user content is owned by Kushii and protected by copyright. You may not copy, reproduce, or distribute any part of the platform without written permission.

10. Disclaimer of Warranties

Kushii is provided "as is" without warranties of any kind. We do not guarantee uninterrupted access or that the platform will be free from errors. Use the platform at your own risk.

11. Limitation of Liability

To the fullest extent permitted by law, Kushii shall not be liable for any indirect, incidental, or consequential damages arising from your use of the platform.

12. Termination

We reserve the right to suspend or terminate accounts that violate these terms. You may delete your account at any time by contacting steven@kushii.io.

13. Changes to Terms

We may update these terms from time to time. Continued use of the platform after changes constitutes acceptance of the new terms.
